Distance Sales Agreement

ARTICLE 1 - PARTIES

1.2. BUYER

The name, surname, address, phone number, and email information declared by the BUYER during the order will be used. The BUYER accepts and declares that this information is accurate and complete.

ARTICLE 2 - SUBJECT

The subject of this Distance Sales Agreement is to determine the rights and obligations of the parties in accordance with the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product, whose qualities and sales price are specified below, which the BUYER ordered electronically through the SELLER's website https://tilavethanem.com.

ARTICLE 3 - PRODUCT SUBJECT TO AGREEMENT AND PAYMENT INFORMATION

The type and category of the product/products, quantity, brand/model, color, sales price, payment method, delivery address, recipient, and invoice information are as stated in the order summary and order confirmation email.

The cash sales prices of the products are shown inclusive of VAT on the order page. Shipping cost, if any, is additionally specified in the payment step and borne by the BUYER.

ARTICLE 4 - GENERAL PROVISIONS

4.1. The BUYER accepts and declares that they have read and understood all preliminary information regarding the basic characteristics, sales price, payment method, and delivery of the product subject to the agreement, and that they have provided the necessary confirmation electronically.

4.2. The product subject to the agreement is considered delivered when it is received by the BUYER or the person/organization at the address indicated by them, provided that it does not exceed the legal period of 30 (thirty) days. The standard delivery period is a total of 2-7 business days, with dispatch to cargo within 3 business days from payment approval.

4.3. The SELLER accepts, declares, and undertakes to deliver the product subject to the agreement sound, complete, and in accordance with the specifications stated in the order.

4.4. For the delivery of the product subject to the agreement, it is essential that this agreement is approved electronically and that the sales price is paid using the payment method preferred by the BUYER.

4.5. If for any reason the product price is not paid or is canceled in the bank records, the SELLER is deemed to be released from the obligation to deliver the product.

4.6. In cases where the fulfillment of the delivery obligation for the ordered product becomes impossible, the SELLER shall notify the BUYER in writing within 3 days from the date they learn of this situation and shall refund all payments collected, including delivery costs if any, within a maximum of 14 days from the date of notification.

4.7. The BUYER is obliged to check the delivered product and, if they detect any damage, defect, or missing items, to have a report prepared by the cargo officer and to notify the SELLER of the situation.

4.8. Persons under the age of 18 cannot shop at https://tilavethanem.com.

ARTICLE 5 - RIGHT OF WITHDRAWAL

5.1. The BUYER has the right to withdraw from the agreement without giving any reason and without paying any penal clause within 14 (fourteen) days from the date of delivery of the product subject to the agreement to them or to the person at the address indicated by them.

5.2. To exercise the right of withdrawal, a written notification must be sent to the SELLER via email at destek@tilavethanem.com or through the contact form within this period.

5.3. In case of exercising the right of withdrawal, the product delivered to the BUYER, along with its invoice, must be returned with its box, packaging, and any standard accessories complete and undamaged.

5.4. Within 14 days from the date the withdrawal notification reaches the SELLER, the product price will be refunded to the BUYER using the payment method they used.

5.5. The return shipping fee under the right of withdrawal will be borne by the SELLER if the SELLER's contracted shipping company is used. If a different shipping company is preferred, the cost will be borne by the BUYER.

ARTICLE 6 - PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

In accordance with Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for the following products:

  • Products prepared in line with the BUYER's requests or personal needs, custom-made products,
  • Products that are perishable or whose expiration date may pass quickly,
  • Products whose protective elements such as packaging, tape, seal, package have been opened after delivery; and whose return is not suitable for health and hygiene reasons,
  • Products that mix with other products after delivery and cannot be separated due to their nature,
  • Services performed instantly in electronic environment and intangible goods delivered instantly to the consumer,
  • Products whose price changes due to fluctuations in financial markets and are not under the control of the SELLER.

ARTICLE 7 - DISPUTES

In the application of this agreement, the Consumer Arbitration Committees and Consumer Courts at the place where the BUYER purchased the product and where they reside, up to the value declared by the Ministry of Commerce, are authorized.

ARTICLE 8 - EFFECTIVENESS

By completing the payment for an order placed through the site, the BUYER is deemed to have accepted all terms of this agreement.
